The Jury as the “Great Equalizer”

Brian emphasized that the civil jury system remains one of the few places where an individual can stand on equal footing with a corporation. Regardless of politics, he noted that the jury system allows 12 regular people to decide a problem, acting as a vital check on power and a “great equalizer” in society.

The Importance of Habits and Structure

Brian highlighted that success in long-term litigation depends on consistent habits.

  • Systematic Approach: By approaching every case with the same rigorous structure, an attorney can trust their past work even years into a case.
  • Growth Through Discomfort: He advised lawyers to put themselves in “slightly uncomfortable” situations to avoid falling into a rut or using old methods as a crutch.

Knowing When to Sit Down

When asked about common mistakes, Brian pointed to the “extra question” in a deposition or trial. He noted that the most difficult skill to master is knowing when you have won a point and having the discipline to stop talking before the jury loses interest or the witness finds a way to unwind your progress.
