When you work hard for your money, it can be heartbreaking and even devastating to lose some or all of it due to a financial fraud scheme. Unfortunately, there are people whose business is built around profiting from the financial loss of others. If any person has taken money from you or caused you to lose money through deception, false pretense, false promise, or fraud, you may be entitled to restitution for your financial loss. If you are a victim of financial fraud, Smith LaCien LLP can help you get justice.

What Is Financial Fraud?

According to the Federal Bureau of Investigation, financial fraud is any act by an individual, a group or a business entity designed to obtain money or other financial assets from a person by deception or criminal activity. There are many different types of financial fraud, including:

  • Bank, mortgage and consumer fraud
  • Credit card fraud
  • Healthcare and insurance fraud
  • Investment fraud
  • Identity theft
  • Embezzlement
  • Advance fee fraud
  • Ponzi and Pyramid schemes

Depending on the precise type of fraud involved, the conduct may include the use of the Internet, phone or mail.

How Can I Prove Fraud Happened?

There are several requirements that must be met to prove that fraud has taken place.

  • The perpetrator provided a false statement as a material fact, knew this statement was untrue and intended to deceive the victim.
  • The victim must demonstrate that they relied on the perpetrator’s false statement and that they suffered damages as a result of acting on the intentionally false statement.

The experienced financial fraud attorney at Smith LaCien can help you gather evidence to prove your fraud case, as well as file a claim. If we determine fraud occurred, our attorneys can help you receive compensation for the damages you suffered.

How Much Time Do I Have to File a Financial Fraud Claim?

The amount of time you have to file a financial fraud claim will depend on the circumstances of your case. For example, any financial fraud claims made under the Illinois Consumer Fraud and Deceptive Business Practices Act must be commenced within three years after the action that caused the victim’s financial loss. In some cases, such as an action based on theft of property exceeding $100,000 in value, or financial exploitation of an elderly person, the victim has ten years from the date of the last fraudulent act committed by the defendant.

Take action against a person who has defrauded you by speaking with a lawyer as soon as possible. Your lawyer will be able to assess the facts of your case and determine whether you have a valid claim.
